Nomination of Goshen Alimentos for deletion

Ronald Hopwood

Re the above article. In April 2022 I uploaded the non-free image File:Ronald Arthur Hopwood 1918.JPG as ID for the article. Although the photo was taken in 1918, the English author Walter Stoneman died in 1958 (less than 70 years ago), so I made sure that that file was small enough, had a user rationale, and had the correct licence.

Unfortunately it has today been replaced by a too-large version of the same image (File:Ronald Arthur Hopwood.jpg), which has a licence which does not take into account the fact that the image is still in copyright in the UK.

I therefore replaced the correctly-sized and licensed image File:Ronald Arthur Hopwood 1918.JPG, and tagged the too-large image, but the same editor has reverted it back to the incorrect, too-large and incorrectly licensed image. They have been robust in their insistence that they have done the right thing.

So, to avoid an edit war, I am requesting you, please, to sort this out? If this is not sorted out within a week, the correct, smaller image will be deleted because that editor has orphaned it. Storye book (talk) 22:21, 26 December 2022 (UTC)

@Storye book: in addition to what I've already communicated to you both in edit summaries and on your talkpage, WP:NUSC is unambiguous: For example, we accept content that is public domain in the US because it was published before 1927 with Template:PD-US-expired-abroad even if it is not public domain anywhere else in the world ‑‑Neveselbert (talk · contribs · email) 23:58, 26 December 2022 (UTC)
@Storye book and Neveselbert: This kind of issue is why I prefer just having files on Commons, since they are the experts at copyright. But as far as I can tell, the larger file is fine here since it is PD in the US, even though it's not PD in the country of origin. Enwiki has different rules from Commons with that kind of case, and US copyright 'wins' because here the hosting is based in the US (excluding caching servers), and enwiki isn't as concerned about non-US reusers as Commons is. Thank you both for the information. I shall make a note of the licensing of File:Ronald Arthur Hopwood.jpg as an example for future use, in that type of situation. In spite of the NPG's posturing, I don't believe that they would get very far in Court regarding internationally out-of-copyright images - and maybe that is why their threat (in the above link) came to nothing. Hence I am happy to continue to use certain internationally out-of-copyright images taken from their website. However the problem that I saw with the Stoneman photo is the potentially defensive nature of the Stoneman estate - after all he was a professional photographer, and there could be people out there who are dependent on its royalties and sales income. That is why I have been so careful with his images. That said, I guess we can all do a happy dance on New Year's Day, when a whole load more images go out of copyright.
