Fair use

There’s no such thing as a fair use claim for a photo of a living person as you can go out and take a photo of that person. The most well known case of this was North Korea’s leader for which Wikipedia had no free photo it could use (and it didn’t matter that you simply couldn’t rock up in North Korea and take a photo).
