The point is that the story told in the movie differs in a significant way from what happened. And for this reason the movie, and Spike Lee, were criticized. See, e.g.: [1] and [2]. P.C. aside, German soldiers did not do this for their entertainment, especially in allied territory--the Italian Social Republic was a valued ally of Germany even then, and massacring loyal Italians obviously a problem. So why did they pick this village? Where there partisans around, and did perhaps these perpetrate some atrocity? More details would help the article. But this kind of behaviour simply reflects the traditional attitude of German people to Italians. They despise Italians since some 1500 years and killed them en masse whenever possible. reprisals against partisans + supporters =/= "massacring civilian". If you analyse the accounts given of the incident it's clearly contradictory, even from the same person. Some facts can however be established. 1.) Some villagers were partisans or supporting them actively or tacitly. 2.) Waffen-SS rounded up villagers. 3.) Some villagers were killed. How this came about is an unclear matter. What is rather obvious is that some people on the Left in Italy try to exploit the incident for propagandistic purpose. So expect this to be blown out of proportion and completely distorted. Btw. Where there ever war criminals that committed atrocities against Germans taken to justice. The Germans were in fact not responsible for the First World War - Austria-Hungary declared war on Serbia which caused Russia to declare war which was allied with France and Germany was drawn in due to its enmity with its rivals and its alliance with Austria-Hungary. This is elementary WWI information - there's no excuse for ignorance. Better check the history books again - Germany not only promised Austria-Hungary full support, but encouraged them - there was a feeling in Imperial Germany that many gains could be made through war. "independence of the German justice system" edit

The article quotes the German Deputy Foreign Minister Michael Georg Link: "while respecting the independence of the German justice system". While the courts and judges of course are independent (apart from what might be going on in the hiding), attorney generals are not. The legal construction of prosecutors allows ministers of justice of the Länder (federal states) to "guide" prosecutors to take certain actions or not. The ultimate means to enforce certain behaviour from prosecutors is to retire or threaten to retire a non-aligning prosecutor. It has been rightfully argued that this political dependency of prosecutors is a potential structural weakness of the institutional design of German state of law. In a first statement on Oct 1, 2012, Minister of Justice Rainer Stickelberger (Socialdemocrats) said something akin to: Sorry folks, there's nothing I can do, procecutors action is based on current judicature.
