Pictures

The easiest way to get photographs is to go out with a camera- but what a day to choose, you need blue sky , low level sun, and sufficient heat so your index finger doesn t fuse to the camera! Images & Copyright question

I've posted this elsewhere, but maybe someone can answer me.

I've been trying to find the answer to a question about images without success. Pictures created before 1923 are copyright expired from what I can discover. Does that mean that I can download a picture of a (pre 1923) postcard from the internet to my computer, and then upload it to Wikipedia, or must I actually have the card in my possession, take my own picture of it, then upload my picture that I took myself? There are pictures that I want to add to articles, but I don't want to break the rules in order to do it! Mjroots (talk) 21:28, 14 December 2007 (UTC)

Postcards

Here's where it gets interesting. In the US there is a famous case called Bridgeman, which held that under US copyright law, exact photographic reproductions of public domain works were public domain. The problem is that no such case has happened in the UK, indeed the work that went into producing a work ("Sweat of the brow") may be enough to re-copyright an exact reproduction. Basically the whole thing is clear as mud. The clearest and most straightforward things to do are either:

  • Contact the seller and ask them for permission to use the images
  • Buy the postcards and scan them

Thanks for uploading Image:Oast7.jpg. I noticed that the file's description page currently doesn't specify who created the content, so the copyright status is unclear. If you did not create this file yourself, then you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, then their copyright should also be acknowledged.

As well as adding the source, please add a proper copyright licensing tag if the file doesn't have one already. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Fair use, use a tag such as {{non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

If you have uploaded other files, consider checking that you have specified their source and tagged them, too. You can find a list of files you have uploaded by following this link. Unsourced and untagged images may be deleted one week after they have been tagged, as described on criteria for speedy deletion. Commons

You may have noticed that I never upload photographs to Wkipedia- where the usage is limited to English Wikipedia. I always put them on Commons then always put a Geotag in the description, so I locate where the camera was when the photo was taken. This then displays on the overlay on GoogleMaps. I have transfered over most of my legacy photos. I will write a section on my user page, sometime today to describe the techniques I use.ClemRutter (talk) 09:28, 21 December 2007 (UTC)

Its not a chore, it's therapeutic! It allows to reconnect with the past! Anyway the description on how to use Commonist and Geo tools is now on my user page. There is a tool to help with geotagging back catalogues- I'll add that next. But in the meantime the article will make the that process 10 times faster. Creative Commons photos on Flickr

Bad news these can't be used- the licence is too restrictive. I am no expert but do watch the Village Pump etc.; these fail because they are non-commercial and non-derivative. You see the licence details on Flickr, under Additional information. There are icons and a link to CreativeCommons, click it. Wikipedia Commons only accepts CC, CC by, and CC by SA licenses- ie completely open licences. ClemRutter (talk) 15:38, 5 January 2008 (UTC)

Mill images

Fair use is independent of the licensing conditions on the site- the whole point of fair use (when used correctly, obviously) is that you may use copyrighted material without consent of the owner. However, I agree that there are a few issues with those images (they're too big, for a start) and as you tagged them, I'll delete under G7- author's request. (Sorry, didn't see your message about putting the comment in the correct place.) Well, as I say, if they are genuinely under fair use, we can use them without paying in legal terms, but I would imagine that they would want to protect their assets if the images have that much commercial value, and may potentially play hell, so finding slightly friendlier images is probably in our best interests! Just happened to see your question here at Jerry's page [1]. Re-uploading with a correct free license is of course legitimate. If you can get the license, that's the best solution all round, no problem, and thank you for your efforts.

HMS Archer (D78)

Thanks for your message on my talk page [2]. My memory of image uploads from four years ago is more than a little hazy, but I will try to help as best I can. Searches at Haze Gray and the Naval Historical Center turned up nothing quite like the photo in question, but I think I found it at NavSource [3]. The image there has "IWM" listed for "Contributed By And/Or Copyright." Today I presume that stands for the Imperial War Museum, but back in 2005 I probably did not know and just assumed it fell under the "Or Images Believed To Be In The Public Domain" listed on the site's copyright information page [4]. However four years later (and with a significantly better understanding of WP:IUP), I recognize that is not a good assumption to make. I also tried searching the Imperial War Museum web site, but while I found a similar photo [5], I could not find this image.

How do you feel we should proceed from here? My recollection is that after uploading around a dozen images of escort carriers in September 2005, I decided that my understanding of IUP was not nuanced enough and I stopped. These images should probably be reviewed and deleted as necessary. I will double-check with a MILHIST coordinator and if they concur, I will start sometime this week.
