Speedy deletion nomination of File:04FEENEYweb-1-superJumbo.jpg.webp

A tag has been placed on File:04FEENEYweb-1-superJumbo.jpg.webp requesting that it be speedily deleted from Wikipedia. This has been done under section F9 of the criteria for speedy deletion, because the file appears to be a blatant copyright infringement of https://www.nytimes.com/2017/04/03/sports/baseball/katy-feeney-dead-major-league-baseball-executive.html. For legal reasons, we cannot accept copyrighted text or images taken from other web sites or printed material, and as a consequence, your addition will most likely be deleted. Wikipedia takes copyright violations very seriously and persistent violators will be blocked from editing.

If the image belongs to you, and you want to allow Wikipedia to use it — which means allowing other people to use it for any reason — then you must verify that externally by one of the processes explained at Wikipedia:Donating copyrighted materials. Michaelajoyce15, please hold on attempting to upload a non-free image of Feeney. There does not appear to be any freely licensed images and attempts at making fair use of an image is complicated and WP:FAIRUSE requires us to satisfy 10 criteria, including that there is a page in mainspace that uses it. Wikipedia and copyright

Hello Michaelajoyce15! While we appreciate your contributions to Wikipedia, there are certain things you must keep in mind about using information from sources to avoid copyright and plagiarism issues.

• You can only copy/translate a small amount of a source, and you must mark what you take as a direct quotation with double quotation marks (") and cite the source using an inline citation. You can read about this at Wikipedia:Non-free content in the sections on "text". See also Help:Referencing for beginners, for how to cite sources here.
• Aside from limited quotation, you must put all information in your own words and structure, in proper paraphrase. Following the source's words too closely can create copyright problems, so it is not permitted here; see Wikipedia:Close paraphrasing. Even when using your own words, you are still, however, asked to cite your sources to verify the information and to demonstrate that the content is not original research.
• We have strict guidelines on the usage of copyrighted images. Fair use images must meet all ten of the non-free content criteria in order to be used in articles, or they will be deleted. To be used on Wikipedia, all other images must be made available under a free and open copyright license that allows commercial and derivative reuse.
• If you own the copyright to the source you want to copy or are a legally designated agent, you may be able to license that text so that we can publish it here. Understand, though, that unlike many other sites, where a person can license their content for use there and retain non-free ownership, that is not possible at Wikipedia. Rather, the release of content must be irrevocable, to the world, into either the public domain (PD) or under a suitably-free and compatible copyright license. Please see Wikipedia:Donating copyrighted materials.
• Also note that Wikipedia articles may not be copied or translated without attribution. If you want to copy or translate from another Wikipedia project or article, you must follow the copyright attribution steps described at Wikipedia:Copying within Wikipedia. Yes, an entire section was very closely paraphrased from the NY Times article in User:Michaelajoyce15/sandbox. I have removed the section and hidden the revisions per policy. @Michaelajoyce15: You must write the article in your own words. Whpq, thank you. I didn't appreciate that sandbox pages are also copyvio patrolled. Michaelajoyce15 did not, though it seems they asked for my review with the problematic text included. I know you are a member of Wikipedia:WikiProject Copyright Cleanup, but how were you notified of the problem? I know I can use the detector and pages but it'd be nice, as an instructor shepherding student articles forward, if I could tag my watched articles and be notified of ongoing issues. Ian (Wiki Ed), is something like this available via the WikiEd dashboard? It already provides useful student and article tracking abilities -Reagle (talk) 17:09, 27 October 2022 (UTC)

The use of non-free content must meet all of the non-free content criteria. In this case, it does not meet WP:NFCC#2 which is about respect for commercial opportunity. The image uploaded was from the Associated Press which is a news agency which licenses its photos so they can be used to illustrate articles. Our usage here is to use the image to illustrate an article. As such, this use does not meet WP:NFCC#2. Almost all usages of commercial photo agencies such as AP or Getty images will not meet respect for commercial opportunity requirement and are speedily deleted under WP:F7. You will need to find an image of Feeney that has been published that is not from a photo agency. Care needs to be taken here that the image is not an unattributed use of a commercial agencies photo. If you find a photo and are unsure of its status, you can leave a message on my talk page and I can have a look, or you could ask at Media Copyright Questions. -- Whpq (talk) 04:12, 4 December 2022 (UTC)

@Whpq and @Explicit, we uploaded this under the "This is a historical portrait of a person no longer alive" rationale. I'm not sure what this "commercial" and "not the subject of sourced commentary" means (despite reading the policy). How is this related to the "This image is the object of discussion in an article" rationale -- which we didn't upload this under?

In any case, whatever this condition is, could it be added to the Wikipedia:File Upload Wizard? Reagle (talk) 21:30, 3 December 2022 (UTC)

I'm not sure adding to the upload wizard would be helpful. The reality is that any number of issues with non-free content could be a problem and trying to screen them out with the wizard would likely make the upload process very cumbersome.

As for "commercial", I hope the above reply answer that question. For "not the subject of sourced commentary", it means that in order to use a photo from a photo agency, the photograph itself must be subject of the commentary versus the person in the photo being the subject of commentary. A concrete example of this would be File:Farrah Fawcett iconic pinup 1976.jpg, the iconic red swimsuit poster of Farrah Fawcett. The usage of that image is not to illustrate Farrah Fawcett, but rather to support an entire article on the poster itself. -- Whpq (talk) 04:20, 4 December 2022 (UTC)

The wizard does say, "We will typically not use a file if its owner has a potential commercial interest in its use, and if our use of it would compete with its original market role." However, I don't understand how a lower resolution version on Wikipedia threatens its market. I understand if this is not the case, but I think I would've understand this better with some tweaks, including removing the fuzzy qualifiers: "We will not use a file if its owner has a commercial interest in its use (e.g., Corbis, Gettys, or any stock image agency), and if our use of it, even at lower resolution, would compete with its original market role". The suggested changes to the upload wizard might be okay. You may want to suggest those changes at Wikipedia talk:File Upload Wizard. as for competing with the original market role, most of these images used to illustrate news articles across the web are used with a reduced resolution as well. And our use to illustrate an article is exactly what these commercial companies are selling; an image licensed for use to illustrate an article. -- Whpq (talk) 17:16, 5 December 2022 (UTC)
