File permission problem with File:John Florescu-TV show.jpg edit

 

Thanks for uploading File:John Florescu-TV show.jpg. I noticed that while you provided a valid copyright licensing tag, there is no proof that the creator of the file has agreed to release it under the given license.

If you are the copyright holder for this media entirely yourself but have previously published it elsewhere (especially online), please either

  • make a note permitting reuse under the CC-BY-SA or another acceptable free license (see this list) at the site of the original publication; or
  • Send an email from an address associated with the original publication to permissions-en@wikimedia.org, stating your ownership of the material and your intention to publish it under a free license. You can find a sample permission letter here. If you take this step, add {{OTRS pending}} to the file description page to prevent premature deletion.

If you did not create it entirely yourself, please ask the person who created the file to take one of the two steps listed above, or if the owner of the file has already given their permission to you via email, please forward that email to permissions-en@wikimedia.org.

Hi MariaOlteanu. The source link you've provided for the above image does not show that any licensing information so it cannot be verified to have been released into the public domain. It also seems that Media Expres S.R.L. is claiming it holds the copyright on the found on its website. Can you provide any further information on why you feel this file is in the public domain and a another link where this can be verified? If not, then please ask the original copyright holder of the image to send a declaration of consent to Wikipedia OTRS for license verification purposes. -- Marchjuly (talk) 01:01, 24 February 2017 (UTC)Reply

It is stated on the online publication website, belonging to Media Expres S.R.L., that they are under the PUBLIC DOMAIN DEDICATION. The person who associated a work with this deed has dedicated the work to the public domain by waiving all of his or her rights to the work worldwide under copyright law, including all related and neighboring rights, to the extent allowed by law (more info here https://creativecommons.org/publicdomain/zero/1.0/). One can copy, modify, distribute and perform the work, even for commercial purposes, all without asking permission. Moreover, on the same page, the Editor in Chief, Mihai-Marian Pavelescu to the extent possible under law, has waived all copyright and related or neighboring rights to this page. -- User:MariaOlteanu (talk) 01:01, 24 February 2017 (UTC)Reply

That may be the case for the content generated by the website itself, but it's not clear whether the photo came from another source. Typically, the copyright for any photo belongs to the person taking the photo unless there has been some kind of official copyright transfer agreement. Can you provide information which shows that this particular photo was taken by Mihai-Marian Pavelescu or that she holds the copyright on it? Lots of websites are able to use photos taken by other individuals based upon the concept of fair use], but the copyright is still held by the original photographer. Moreover, the website is still listed as being under copyright protection despite the declaration of public domain, so they seem to be contradicting themselves. Only the original copyright holder of the image can agree to release the license under a free license. If the copyright holder is Media Expres, then they need to send a explicit declaration of consent to Wikipedia OTRS for verification. Once they send in the email, a Template:OTRS pending can be added to the file's page which will give an additional 30 days for the file's licensing to be verified. You need to make sure that they understand that a free license means that they agree to give permission to anyone anywhere in the world to download the photo and use it for any purpose, including commercial. They cannot just agree to allow the photo to be used on Wikipedia. You also need to make sure that they understand that they cannot claim ownership over someone else photo.
