How can one be "charged with the death penalty"? One is charged with a criminal offence, such as murder, which might carry a death penalty as a sentence, if one is found guilty and convicted of that offence. But one cannot be charged with a death penalty. If people were, they would be executed upon being charged, without the bother of a fair trial finding them guilty. That might be the case in some jurisdictions, but I think the American justice system at least has a due process where people are given a trial first.
