Amendment disallows approval of same-sex marriage by legislature? edit
Now that same-sex marriage is about to be legalized in Hawaii, some are arguing that this amendment prevents the legislature from legalizing same-sex marriage. It would be interesting to know their line of reasoning. 173.180.113.56 (talk) 23:39, 9 November 2013 (UTC)
- There's a misunderstanding by opponents of SB1 that this constitutional amendment doubled as a referendum on legalizing same-sex marriage, because had the amendment failed, the decision by the Hawaii Supreme Court in Baehr v. Lewin would not have been effectively overruled and the state would have been constitutionally obligated to issue marriage licenses to same-sex couples. Before the special session opened, a member of the Hawaii State Senate requested a formal opinion from the state Attorney General (AG Opinion 13-1), which states that there is no doubt that the Legislature has the authority to enact SB1. I don't see any reason to include any discussion of the constitutionality of SB1 in this article. Musashi1600 (talk) 11:34, 12 November 2013 (UTC)
