  • You should probably email WP:OTRS to clear up the licensing. On the one hand, you claim that US copyright has expired. On the other, you claim that the artist has given you permission to use the image on Wikipedia. Someone cannot "copyright" an image under USA Law. An Image must be TRADEMARKED. There are no COPYRIGHTs on the image in use. WIKIPedia must make the difference between Copyrighting and Trademarking known, or the stance is not valid.

Yes the image upload itself had disappeared and the image on the page, as well as the image box in which it was published was edited to remove the image. I used Lachlan 1793, that is my only account. As far as coyrighting and image, that CANNOT BE DONE under USA law. An image must be TRADEMARKED and the trademark must be registed with US Trademark Office in Washington, D.C. The trademarks of the image are expired.

Do not upload the image again until you understand copyright policy. WP:COPYRIGHT and WP:NONFREE is a good start. ST47 (talk) 16:42, 21 October 2019 (UTC)Reply

I am a new user, you could have cut me some slack before you blocked me, however I understand why I was blocked. I should not have been rude. But folks, you need to really understand the copyright laws in the USA. I do know them. I am a published author. Simply producing a work, image, text, music, etc. does not mean anyone has a legal copyright. An example is someone posts a written work on the internet simply for information purposes, but does not legally copyright that information, then someone, anyone, comes along and copies that text and sends it to the copyright office as their own work. It is now copyrighted and the thief is now the copyright owner. If no one claims a work, anyone can take it and copyright it, if the author does not take action to protect his work. On the other hand, if a person does not care if his work is copied or not there is NO copyright attached to a work, anyone can use it, or even copyright it. It is then considered PUBLIC DOMAIN if not copyrighted. WIKI policy does not address his situation, which is what I was trying to explain and got shot down. Sorry for being rude, but I got frustrated trying to explain this. I will certainly be more polite in the future, but please do try to understand my frustration, when my edits were repeatedly revoked. Thank you

I have read it four times, just to make sure I did understand. I am a published author and have been in contact with the copyright office before my works were ever published. I am sorry that my view and Wikipedia's do not match. That said, I will abide by Wikipedia's stance, otherwise you the block will continue. My only intent is to provide good, concise, historic information. Wikipeida is great service to readers looking for information and I would not like to jeopardize that effort. I have been a money contributor to Wikipedia, as well. I will use the appropriate tags and/or permissions that may be required according to Wikipedia's policies. I do have a question however. How do I submit permission for an artist's work (as Wikipedia may require) to use his work? I did not see a venue for doing so on the copyright discussion page. Thank you for your consideration. One additional note, one of the admins, selectively removed historic, heraldic information from the infobox on the Clan MacTavish wiki, and now the Clan Members Crest Badge description is incorrect. What is there currently, that I cannot now correct being blocked, is the description of Chief's Crest Badge. I am wondering if the admin does not understand the difference between the two badges, or perhaps, he/she does not understand Scottish heraldry. How do I submit permission for an artist's work (as Wikipedia may require) to use his work?
The artist would need to email Wikipedia (or the Wikimedia Commons) to confirm that the material has been donated or otherwise freely licensed for any derivative use, including commercial re-use. There's no reason for you to send me e-mail. For you to continue to challenge Wikipedia's copyright policy is partly what got you blocked in the first place. Unless you have something new to say, I will likely revoke your access to this page. And lose the "totalitarian" rhetoric.
