@Stefan2: could you please help me out here. I referenced File:Helpful information about your telephone service Manhattan 1940.jpg in a footnote on page 4-1-1 in my edit of that page at 20:26, 28 May 2014 (UTC). Later I added two other file pages which further document the use of 4-1-1 and 1-1-3 as to date and place, but in all three cases the files appear to be orphaned, i.e. no usage on wikipedia shows. Must I have the images show on the page? Shouldn't <ref> New York Telephone Directory for Manhattan, 1940, page 1</ref> count as a usage and keep the files from being orphaned? Linking to a file does not constitute use of the file, and besides such use would violate WP:NFCC#8.

Are you really sure that the file still is copyrighted? Did the phone book publisher really submit a copyright renewal application 28 years after the phone book was made? Phone books are usually only interesting when they are new, not 28 years later (and most pages are uncopyrightable per Feist v. Rural). You can probably change the copyright tag to {{PD-US-not renewed}}. --Stefan2 (talk) 10:14, 29 May 2014 (UTC)

@Stefan2: Thanks very much for pointing out the {{PD-US-not renewed}} possibility. I'm changing the tags and the descriptions for all three files now. Feist v. Rural might not apply, since that was a case about mechanically copying and republishing the name and address listings in a separate directory, whereas my use is an actual copy of a page of introductory material. Should I really check for non-renewal, or just assume that it wasn't renewed? And finally, the page is still "orphaned" even though it is linked from the article. That may not matter if PD content is not subject to orphanage deletion, but it seems to be a technical issue unrelated to copyright -- I would think that the usage tracking system should find footnote usage, and I would like the usage tracked in any case. The reason I was able to edit after placing this request was that I had turned off IPv6 for Wikipedia!
