File Copyright problem

Thanks for uploading File:First smiley.jpg. I noticed that the file's description page currently doesn't specify who created the content, so the copyright status is unclear. If you did not create this file yourself, you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, their copyright should also be acknowledged.

As well as adding the source, we also need to know the terms of the license that the copyright holder has published the file under, usually done by adding a licensing tag. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Non-free content, use a tag such as {{non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

If you have uploaded other files, consider checking that you have specified their source and tagged them, too. You can find a list of files you have created in your upload log. Unsourced and untagged files may be deleted one week after they have been tagged, as described on criteria for speedy deletion. If the file is copyrighted under a non-free license (per Wikipedia:Fair use) then the file will be deleted 48 hours after 11:42, 15 December 2010 (UTC). If you have any questions please ask them at the Media copyright questions page. Thank you. Sfan00 IMG (talk) 11:42, 15 December 2010 (UTC)Reply

License tagging for File:Knocking.png

edit

Thanks for uploading File:Knocking.png. You don't seem to have indicated the license status of the image. Wikipedia uses a set of image copyright tags to indicate this information; to add a tag to the image, select the appropriate tag from this list, click on this link, then click the "Edit" tab at the top of the page and add the tag to the image's description. If there doesn't seem to be a suitable tag, the image is probably not appropriate for use on Wikipedia.

For help in choosing the correct tag, or for any other questions, leave a message on Wikipedia:Media copyright questions. Thank you for your cooperation. --ImageTaggingBot (talk) 14:05, 15 December 2010 (UTC)Reply

Administrators' noticeboard

edit

Hello. This message is being sent to inform you that there currently is a discussion at Wikipedia:Administrators' noticeboard regarding an issue with which you may have been involved. Thank you.

Basically, I'll have to ask you very good secondary sources for your claims. For what I know, this is a controversial topic that you are depicting like a consensual fact. Iluvalar (talk) 19:33, 21 December 2010 (UTC)Reply

Please don't delete the infobox from an article just becuse you disagree with sourced facts. If you don't like the content, then you need to find sources to show that the facts are incorrect or different --Enric Naval (talk) 12:55, 22 December 2010 (UTC)Reply

Hello, I am the one who created the infobox, dispaying the correct information on it. However someone changed it to display wrong information and put an image that infragment the copyright of the Smiley face (yes it is trademarked and copyrighted). In fact not only the face but also the name are protected. I deleted the infobox temporarly, the time to find a way to upload the copyrighted which is the only one acceptable when you speak about the name "Smiley". if you can help me to upload this image to somewhere else than wikimedia as it does not allow copyrighted image that would be helpful. --Drinas (talk) 15:48, 22 December 2010 (UTC)Reply

I checked the Smiley Company's website[1], it says "Copyright - 1000's of icons are protected by copyright for all products and service worldwide". That doesn't sound to me like having the copyright for the generic smiley face. You should provide an independent third-party source for that claim (usually a newspaper article will do, sometimes people manage to find books on copyright that cover the topic).
Anyways, I'll try to dig up some sources, since the article is a bit incomplete (for example, it lacks the exact year for Harvey Ball. And, according to the BBC, a guy called David Stern also claims being the creator) --Enric Naval (talk) 17:18, 22 December 2010 (UTC)Reply

Yes SmileyWorld (franklin and Nicolas Loufrani's company) owns the right of the Smiley face and the name that is registered in 100 countries over 25 classes of goods. it is written on the link you just gave... The copyright concern SmileyWorld icons and the Smiley original is copyrighted and trademarked. Harvey balls claims to have designed it but there is exemples that shows it is not true, you will find previous use of happy faces e.g with the WMCA good guy (sse the article). The true first exemple of a happy face is even a 2500 BC year old stone: http://smileycompany.com/company/?page=cms&cms_id=8 For other reference showing that SmileyWorld owns the rights over the Smiley face you can see this links http://www.nytimes.com/2006/06/25/technology/25iht-smiley.html with the quote: ""A prehistoric man probably invented the smiley face in some cave, but I certainly was the first to register it as a trademark," said Franklin Loufrani, 63, who says he initially registered the design with the French trademark authorities in October 1971. " --Drinas (talk) 17:54, 22 December 2010 (UTC)Reply

The smiley face logo cannot be copyrighted, there is too little originality to it. It is a public domain image. See [2] and [3]. Trademark and copyright are not the same. Fences&Windows 19:42, 22 December 2010 (UTC)Reply
Please see Talk:Smiley#Harvey_R._Ball_as_creator.2C_copyright_issues. Don't revert again without providing solid sources.
I note that the NYT article is about trademark lawsuits, not about copyright? (among other things, I noticed that the word "trademark" appears 23 times, and the word "copyright" appears zero times...). --Enric Naval (talk) 21:16, 22 December 2010 (UTC)Reply

Speedy deletion nomination of Drinas/Nicolas Loufrani

edit

If this is the first article that you have created, you may want to read the guide to writing your first article.

You may want to consider using the Article Wizard to help you create articles.

A tag has been placed on Drinas/Nicolas Loufrani requesting that it be speedily deleted from Wikipedia. This has been done under section A7 of the criteria for speedy deletion, because the article appears to be about a person or group of people, but it does not indicate how or why the subject is important or significant: that is, why an article about that subject should be included in an encyclopedia. Under the criteria for speedy deletion, such articles may be deleted at any time. Please see the guidelines for what is generally accepted as notable.

If you think that this notice was placed here in error, you may contest the deletion by adding {{hang on}} to the top of the page that has been nominated for deletion (just below the existing speedy deletion, or "db", tag; if no such tag exists, then the page is no longer a speedy delete candidate and adding a hang-on tag is unnecessary), coupled with adding a note on the talk page explaining your position, but be aware that once tagged for speedy deletion, if the page meets the criterion, it may be deleted without delay. Please do not remove the speedy deletion tag yourself, but don't hesitate to add information to the page that would render it more in conformance with Wikipedia's policies and guidelines. If the page is deleted, you can contact one of these administrators to request that the administrator userfy the page or email a copy to you. Hi there. I've moved this to your userspace, which I'm guessing is where you meant to put it. It's at User:Drinas/Nicolas Loufrani. When you're creating in your userspace, remember to put 'User:' before your username, otherwise it ends up in the mainspace. Don't worry though, it's easily done! GedUK  21:12, 28 February 2011 (UTC)Reply

Thanks for moving it, However I was waiting for feedback. Do you think I can publish the article now? Thanks--Drinas (talk) 14:19, 9 March 2011 (UTC)Reply

This is an automated message from CorenSearchBot. I have performed a web search with the contents of Nicolas loufrani, and it appears to include material copied directly from http://wikibin.org/articles/nicolas-loufrani.html.

It is possible that the bot is confused and found similarity where none actually exists. If that is the case, you can remove the tag from the article. The article will be reviewed to determine if there are any copyright issues.
