Was she passed out?

A recent edit removed references to the lead character being passed out and being raped, instead changing it to her agreeing to sex as payment for legal services. This is obviously a sensitive area where it's important to neither oversell or undersell whatever happened. I haven't seen the movie, so can someone clarify simply - was she passed out or not? Relevant to note that even if she did agree to have sex with the man, having sex with her while passed out or heavily intoxicated is still sexual assault, unless she specifically agreed before reaching that state "yes if we get home and I pass out I would like you to have sex with me". Watched the scene. Yes she was completely passed out, and was also nonverbal when the lawyer roused her enough to have sex with her. It was clearly rape. Additionally there was no agreement about sex for services, in fact he declared "don't worry about the money" before she approached him physically at all, nor did it appear they actually discussed sex.
