because it's not public domain under any interpretation, unlike the 1820 sonata which at least can be considered even in its 1977 (and first) publication a work-for-hire, or of course the op.4 sonata which is of course public domain, etc. This was first published in 1953 (with, to my knowledge, the needed copyright notice- if not, then maybe it's ok after all- in the US only) in an edition (the sticking point being the editor, Yehudi Menuhin, who discovered the work (among Mendelssohn's papers? in a library? I don't know, actually...) and who died too recently for Canadian or European copyright law to just ignore that and who wasn't performing work-for-hire.) The first edition I think was OCLC 497163223 (and incidentally gives the completion date of the sonata as 15 June 1838.) We do try to be somewhat careful about copyright over on IMSLP, esp. since we've already closed for 2 years because of a dispute you may recall. (I'm an admin there, though not a copyright-admin.)
