I am an eNotary in the Commonwealth of Pennsylvania. Within the Commonwealth of Pennsylvania, a commissioned Notary Public, must apply and be commissioned as an eNotary for the Commonwealth. The individual then is eligible for their digital seal, which is purchased after verification of identity by a participating Recorder of Deeds. The term is currently one year, and there is an incremental cost. Enotarizations have occurred in Pennsylvania. Enotarization is not webcam notarization edit

Today a editor removed California from the list of states where enotarization is occurring on the basis of this website:

That site is down, but searching ca.gov finds for webcam notarization produces this summary:

Customer Alert - Notary Public - California Secretary of State

Feb 24, 2011 ... Online webcam notarization is invalid and illegal in the State of California. A private company claims to have the first online notarization website ...

I have read this warning in the past. It points out that enotarization where the signing is performed on a computer is legal so long as the signer is physically present with the notary; that is, the notary could touch the signer within a few seconds. Purported notarizations where the notary interacts with the signer at a distance using a webcam or similar technology are illegal in California (and everywhere else, as far as I can tell).
