Fair Use rationale for Heath Ledger

The Fair Use Rationale for the article Heath Ledger ought to be removed. I have already removed the photo from the article.
The template {{filmrationale}} (which is used) lists the following rationales:
- No free equivalent exists that would effectively identify the article's subject.
- The image does not in any way limit the ability of the copyright owners to market or sell their product.
- The image is only used once and is rendered in low resolution to avoid piracy.
- The image has been published outside Wikipedia; see source above.
- The image meets general Wikipedia content requirements and is encyclopedic.
- The image meets Wikipedia's media-specific policy.
- The image is used in the article wiki-linked in the section title.
- The image is significant in identifying the subject of the article, which is the film or film character itself.
- The image is used in the article namespace.
- The image has a brief description that identifies the image, notes the source, and provides attribution to the copyright holder.
- 1- This is ridiculous as the subject, Heath Ledger, is already effectively identified by the other free images on the page.
- 8 - Neither the film nor film character is the subject of the article.
However, the real problem is that the article barely makes mention of the film of character, thus making the image use decorative, which is not consistent with fair-use policies. -Seidenstud (talk) 03:56, 12 July 2008 (UTC)

The rationale for usage in "Joker in other media" should be removed - that article has been merged into the Joker page, which uses a different image of Ledger's Joker. The Clawed One (talk)
