Any other crimes of morality? edit

I think crimes such as possession of drug paraphrenalia should be added to the list. Having a weed pipe in your pocket on your 18th birthday is certainly a reason why people are permanently kept out of work through background checking agencies. If there is a legal reason why this occurs other than through a judgment of "good/bad moral character", I'd like to hear it. In any case, I would be very happy to see the employment section expanded. Aliens edit

I see one of the criteria given is being guilty of 'alien smuggling'. Quite right too: anybody caught trying to smuggle those pesky Martians into the US of A is clearly not of good moral character and should be whipped out of town. Enaidmawr (talk) 19:01, 13 July 2009 (UTC)Reply

In the Last 5 Years edit

There's a reference to offenses committed during "the five years preceding application." That's an outdated standard. There are some old Department of Justice documents still out there talking about that rule as it applies to judicial deportation (see http://www.usdoj.gov/usao/eousa/foia_reading_room/usam/title9/crm01934.htm) but that part of the Immigration and Nationality Act has long since been amended and transferred from 8 USC 1251 to 8 USC 1182. (see http://www4.law.cornell.edu/uscode/html/uscode08/usc_sec_08_00001182----000-.html) Also, the "What is Good Moral Character" checklist cited as a reference at http://careers.findlaw.com/firmsite/attachments/LE6_c_checklist_WhatIsGoodMoralCharacter.pdf seems to be outdated as well.--Sophosmoros (talk) 16:18, 26 July 2009 (UTC)Reply

Gambling edit

Perhaps you should be an administrative law judge, but even good judges are often structurally bound by improperly argued prior cases from superior courts.

The down side to reliability, i.e., the downside to stare decisis is that erroneous law can become ingrained to do harm instead of good. Clearly erroneous case law can emerge amidst an improperly researched and argued case. The superior court adjudicates what is before them, and then the lower courts are bound to follow.
