I really like the individual discussion of court cases, and would like to see a separate page on Enmund v. Florida. 128.12.32.199 23:21, 13 November 2006 (UTC)

This page will consolidate discussion of Enmund v. Florida, 458 U.S. 782 (1982), and Tison v. Arizona, 481 U.S. 137 (1987). These two cases set forth the rule under which the death penalty is authorized for felony murder in the United States. I'll leave it to you as more of an expert, but will this page as titled ever see any visitors? Is the topic worthy enough of its own article or should it be part of either felony murder or Eighth Amendment? Thoughts to consider. CPAScott 03:18, 9 August 2006 (UTC)

Oh yes, I'll eventually modify the felony murder page to point here. But the question about the propriety of felony murder as a crime is distinct from the question of whether felony murder should be a capital crime. But I can't do it all at once! ---Axios023 03:20, 9 August 2006 (UTC)

Regarding the suggestion to incorporate this discussion into the overall discussion about felony murder, I think that would be a good idea if that page were better written. I'd tackle it, but I'm not as much of an expert as I'd like to be; all I know I learned in a haze during first-year criminal law. ---Axios023 05:37, 9 August 2006 (UTC)

This looks to me like it belongs as a section in the broader article. I'm not sure what you mean by "if that page were better written." One of the things that article needs, and I should have finished my rewrite before getting distracted by other projects, is just this sort of discussion. If any non-US jurisdiction still uses the rule, then we could fork by country, as in the case of Murder, when we have enough material. Robert A.West (Talk) 17:36, 9 August 2006 (UTC)
