- It’s not a cover. A cover is a recording intended to COVER, mask, hide, commercially obliterate, another recording (hence the name), whereas Midler’s recording of the song was not even released as a single. It works like this: Royalties for songwriter contributions are set by the federal government at a fixed very low rate, such that it is almost impossible to make a living as a songwriter on royalties alone. The law also stipulates that anyone can record a song after it has been published or commercially recorded as long as he pays the fixed rate, but no one can record an unpublished, unrecorded song without express permission from the writers. This is why professional writers always demand a large one-time fee in exchange for the first recording. Consequently, it was once fairly common and unethical practice for a singer to re-record a song starting to make its way up the charts, squelching its progress free of charge. ~~~ TheScotch (talk) 17:38, 1 November 2024 (UTC)
