Removal of category from your userpage

Hi. In enacting consensus from User categories for discussion, I have removed the category Category:Wikipedians interested in books from your userpage. It was determined in that deletion debate that this category should be depopulated of individuals, but kept as a parent category. If you wish to display a category reflecting your interest in books, please consider one of the specific sub-categories under its umbrella. Username Usurpation

I understand this, however, due to this user's high inactivity, and as far as I see, the very unlikely event that this person is to return, I do not see why the usurpation request is being denied. Axmann and AxMann are two different usernames, in my opinion. Doesn't the GFDL state that a person's edits can be altered "mercilessly"? It's not like he has a right to keep those edits there, considering that Wikipedia is not bound by Amendment 1 to the Constitution of the United States of America (as I have learned the hard way).
