The reply was that because the work is attributed to the photographer that the copyright automatically reverts to him and to use the picture the photographer would have to email that you have the copyright, a messy story, as I said I suggest if you have one a simple portrait style photo taken on your camera and uploaded, that way you can clearly public domain the pic, let me know if you have any questions.
