Fair use rationale for Image:Shock+value.jpg edit

Thanks for uploading Image:Shock+value.jpg. I notice the 'image' page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in Wikipedia articles constitutes fair use. When you use a generic fair use tag such as {{fair use}} or {{fair use in|article name}}, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use.

Please go to the image description page and edit it to include a fair use rationale.

Request of Unblock edit

-Those images have the right copyrights yamla! this isn't fair.One is a cover of a cd (Image:Shock+value.jpg) that is coming out and the other is a screenshot of the music player software on the site(Image:Jttour07.JPG).For once i uploaded the right tags and you block me for six months?!?!?! this isnt fair! I request a unblock because I have not done anything wrong in the last month and those pictures ahve been up for a WHILE.I put the right copyrights on both,what is the problem?? SIX MONTHS???!?!?!?!?this is not fair.you have really discouraged me from editing on this site.I understand theres been alot of problems with my images but this just isnt fair.I feel like this is personal.

2.No free or public domain images have been located for this album cover.
3.The album cover does not limit the copyright owners' rights to distribute the image in any way.
4.The album cover is being used for informational purposes only, and its use is not believed to detract from the artist in any way.

A few things. First, Jttour07 is also being used on the Pink page. It is entirely possible that you did not add it there. Second, I can find no evidence that FutureSex/LoveShow is providing any critical commentary on this poster. It appears to be used solely for illustration which would be a violation of the copyright license. Finally, and this is new today so you are not being held to this standard, the Wikimedia Foundation is handing down a clarification on fair-use. This will likely result in us not being able to use fair-use images such as these two. This is a big deal. It means probably over 90% of the fair-use images currently on the Wikipedia will have to be deleted. I'm giving this to you as a heads-up. Anyway, please consider what I've said here and ignoring the bit about the Wikimedia Foundation, please reconsider the rationale for that second image. If in your opinion no fair-use rationale suffices, that's a reasonable answer as well. I'm not saying this is necessarily the case here, though. --Yamla 20:07, 8 February 2007 (UTC)Reply
Well I do agree with you on that it isn't providing any critical commentary.That was a typo.But it is providing a screenshot of the two people on the tour and as well as part of the tour dates to prove the tour dates on the article. so is this better?

If this isnt right then I think it should be deleted until a better image is found. Im sorry,very, about my image uses on Wikipedia.I know me and you have had our run ins but I do think you are a very fair by the book editor.I swear to use rationale for future image uploads to the best of my ability.With that I still request a unblock.If not a unblock, maybe a shorter sentence?This was truly a mistake.

Image:Jttour07.JPG may only be used "for identification of and critical commentary on the software in question" according to the license. No fair-use rationale allows you to use it for any other purpose. So unless it is being used to depict the software (rather than the tour) and unless you are providing critical commentary rather than simply illustrating the software, it is a violation of copyright. Anyway, I am now sure that you are familiar with detailed fair-use rationales and will include them in future images that you upload. There may be cases where you use an image in violation of the license, or with an insufficient rationale, but mistakes happen. The main thing is that you are clearly going to add rationales to the images you use and to make a good-faith effort to do so correctly. Sorry if that was harsh....but it's gramatically incorrect to not have a space after a period...not to mention *extremely* hard to read when you have a whole paragraph with no spaces.
