Smith v. Summit Entertainment LLC 3:11CV348 (United States District Court, N.D. Ohio, Western Division) is a case heard by the United States District Court for the Northern District of Ohio, in which Matthew Smith, a professional singer also known as Matt Heart, sued Summit Entertainment. Smith asserted seven causes of action for Summit Entertainment's wrongfully use of copyright takedown notice to YouTube.
Facts
Smith a song he copyrighted in 2002 on various Internet websites (YouTube, iTunes, CD Baby and Amazon) in the month of November and December 2010. Summit Entertainment contacted YouTube to take down Smith's song because it might have violated copyright laws.
