Fornication

edit

The phrase "taking (them) in marriage not committing fornication" implies that this is the legal prevention of fornication.

It is forbidden to posses a women without Nikah(wed lock) as well as marriage is not the name of fulfilling the sexual desires.

If any of you have not the means wherewith to wed free believing women, they may wed believing girls from among those whom your right hands possess: And Allah hath full knowledge about your faith. Ye are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that ye practise self-restraint. And Allah is Oft-forgiving, Most Merciful. [QURAN CHAPTER#4:VERSE#25]

The verse that was quoted for Nikah Mut'ah from [QURAN CHAPTER#4:VERSE#24] was out of context, You have to read it completely in order to understand it. It was revealed during the battle to mention that it is permissible to marry someone who you captured in the war and is previously married with mushrik provided you must not marry them for sexual desires but rather then to establish a muslim family as well as you have to pay their Mahar same as like a normal marriage right at the time of wedding.

وَأُحِلَّ لَكُم مَّا وَرَاء And permissible for you those others besides them(who are already married except if they are caught in the war and you marry them legally)

ذَلِكُمْ أَن تَبْتَغُواْ بِأَمْوَالِكُم مُّحْصِنِينَ غَيْرَ مُسَافِحِينَ (they are same as) that you pay mahar to bring them in your Nikah not for sexual desires.

So whoever you get from them (whoever you have captured and now willing to marry) pay their mahar as a compulsary , and it is not sin if you both agree to a term after Mahar is fixed (if wife wish to return some of it back to husband it is permissible or husband and wife agree on something about Mahar), and Allah is All-knowing, All-wise

The above ayat is emphesising on Mahar husband gives to wife that it is compulsary to give mahar regardless. Unless you both husband and wife come to common terms.

    • There is no indication of temporary marriage or marriage for secual desires**
