What's with the copyright statement in the file's metadata?

Near the top of the page, there is a copyright statement that claims that this picture is not copyrighted because it was first published a long, long time ago.

This media file is in the public domain in the United States. This applies to U.S. works where the copyright has expired, often because its first publication occurred prior to January 1, 1923. See this page for further explanation.

Moving further down the page, there is a metadata section that contains:

This photograph is protected by United States copyright law and may not be reproduced, distributed, transmitted, displayed, published or broadcast without the prior written permission of the copyright owner. Licensing requests should be sent to photosales@nytimes.com.

Obviously, one of these statements is not true, and we need to know which one is false, and we should either remove or correct it.
