The photograph is assumed to be in the public domain as the subject of the photograph died over 100 years ago (in 1907) and therefore it is highly unlikely that the author of the photograph to have died less than 50 years ago. New Zealand copyright law states that photographs enter the public domain 50 years after the death of the author. Furthermore, as the subject died in 1907, the image must have been taken prior to 1907 and qualifies for Public Domain in the US as it was published outside the US prior to 1923.
