Photograph of the East Side Playhouse, 1985, by Michael F. Donadio. The building, located at E. 74th St. in Manhattan, was demolished in the 1980s.

The late Jerry Gotham (choreographer) and the late Raymond Allen (stage actor), who were the co-directors of the Light Opera of Manhattan when the photo was taken, are standing in front of the building.

The image qualifies for the fair use exception to the copyright laws because:

  • This photo is being used to illustrate an educational article about the theatre company resident at the theatre, the Light Opera of Manhattan, which performed at the theatre for a decade until the theatre closed in the 1980s;
  • The subject of this publicity photograph, the East Side Playhouse, was destroyed, and so the photo is a historic photo that cannot be replaced;
  • The persons whose images appear in the photo, Jerry Gotham (choreographer) and the late Raymond Allen (stage actor) are deceased;
  • It is a low resolution image; and
  • Use of the image will not deprive the copyright holder of any income or opportunities to exploit the image.
