Fair use applies in this case, as this is a still from a closed-circuit television camera, of Alderton's last known movements. The large-scale media coverage, was related to the fact the police were required to determine the last movements of each of the five women in the 2006 Ipswich murder investigation.

The image itself is a low-quality image, has no apparent commercial value, and it was released publicly, by the Suffolk Constabulary, with no profit-related motive, in order to encourage public response.
