The funeral of Judge James D. Fox. Chief Justice of the Supreme Court of Missouri, who died Thursday night at the Josephine Hospital, will be held Saturday from his former home at Fredericktown, Mo.

All the State officials and Judges of the Supreme Court will attend in a body. The honorary pallbearers will be the present Judges of the Supreme Court, and former Judges Warwick Hough and Marshall of St. Louis. W. M. Williams of Boonville, and Shepherd Barclay of St. Louis. Judge Fox came to St. Louis Wednesday suffering from a severe headache, and after spending part of the day and night at a hotel he went to the Josephine Hospital, Grand and Henrietta avenues, to seek relief. After he had been assigned to a room and had received medical attention at the hospital he seemed to be in a better condition. The attending physician. Dr. F. G. Pernoud, was called, however, at 6:15 p. m., Thursday, by a nurse, who said the judge was in a critical condition. He hurried to the bedside and found Judge Fox dying. He died from a stroke of apoplexy. His family and the associate judges were notified immediately. Judge Gavon D. Burgess will succeed Judge James Fox, as Chief Justice of the Supreme Court. Judge Gantt says the death of Judge Fox will effect many cases pending before the Supreme Court, and nearly all argued before the deceased judge will have to be heard again. Governor Hadley will probably appoint as judge the person nominated by the Republican Central Committee to make the race as Judge Fox's successor. This man will serve the unexpired term on the Supreme bench which will be to January 1. Judge Fox was born in Fredericktown, Mo.. January 23, 1847, and was educated in the schools of the neighborhood and at St. Louis University. He was admitted to the bar in 1866. He was elected on the Democratic ticket to the Circuit Court of the Twentieth Judicial Distinct in 1880 and was re-elected in 1886, 1892 and 1898. He was nominated for the Supreme Court in 1902 and following his election took his seat on that bench in January 1903. He was elected Chief Justice in May of the present year, to succeed Judge Le Roy B. Valiant. His term would have expired In January, 1911.

Fox is survived by a widow, a daughter.
