Fair use rationale for Image:Ali Sarmini.jpg edit

I notice the image page specifies that the image is being used under fair use but there is not a suitable explanation or rationale as to why each specific use in Wikipedia constitutes fair use. Please go to the image description page and edit it to include a fair use rationale.

What is your problem with SmackBot? edit

I'm not sure what your comment was about in respect of SmackBot and your article about Ali Sarmini.

All it did was update some tags to include the date they were added, and correct some internal (wiki)links to remove unnecessary underscores, to match the standards and guidelines set down by Wikipedia. It did not object to - or change - any of the information presented in the article. Thank you so much, already twice, Lynbarn! :) I'm a newbie so not enough skilled yet fix problems. My problem for last time is actually a notes made by User:Carlossuarez46 and not by SmackBot. Improper tone of article, unconfirmed sources, unknown person - I have fixed the required parts of it (as sources), but not sure if he'll accept it.

In fact, if you could help me, I have a question. A picture of Ali Sarmini in my article is taken from his site. In fact, The picture depicts an author of paiting described in article and I believe is low resolution and reduced quality, so can be used here. I also have direct contact with representatives of Ali Sarmini, to whom I might ask for permission of author, however I consider it's pointless as I provide it her for study purpose, not for commerce or stealing HQ picture to claim it's mine..

but how do I describe it? Besides, a picture is "sentenced" for deletion by tomorrow, then I'll have to re-upload. How should I write that there is not reason for it?

I read rationale guide-lines, but actually got more confused neither understood. Instead of giving just list of commands I should write for this or that use, there is large list of acceptable use. The problem with the photo is that the copyright belongs to the photographer, UNLESS it is specifically given away as in the public domain. Wikipedia is very tight on this aspect, as I guess it has caused problems in the past. If you can get an email or similar from the photographer, or from the owner of the website to say that all images are copyright-free, or that they release the photo for use anywhwere, then you can add that to the image, and it will be allowed. It is a bit of a minefield though, and one I have tripped up in myself before now! If you want more assistance from people more expert than I, you mightwant to try looking at the various Village pump pages, and asking about copyright etc. there. Good luck! Dear Lynbarn,

I would like to thank you again for your help. With all respect to you personally and to Wikipedia, it's pretty clear that laws of U.S. are often completely not applicable to other countries, especially Middle Eastern. For example, by Lebanese law, you have right to copy anything (images, video and audio) as long as you do not receive financial revenue from it. In Syria it has no problem to take small picture of a famous person to use in Encyclopedia. In Egypt - there are hundreds of websites with all of their productions distributed completely free with no legal rights. And in Gulf countries, few of similar distribution sites (mp3 and photos of famous stars of cinema and music) are made by their proper owners (satelite broadcasting companies) and no body cares for it's legal rights or those who copy it for personal or non-profit use.

Therefor, it's even teoreticaly absordish teory that anybody should present some sort of license for production of Middle Eastern countries, as long as these countries do not provide any laws or regulations that actually work, and not just "empty sound".

But how to explain this to Wikipedia copyright fighters? Impossible, in my opinion.

Your article Ali Sarmini has been placed in deletion discussions: he would be notable if what you quote is proven true: "Director of the Russian Business and Management Group, Andreas Churkin announced that the painting will be auctioned at the end of August and its initial price will be USD 200 millions" and it sold. However, I can paint any thing and say it is up for bid for $200 million and it won't sell either. Show me it sold for >$200 million as reported in a reliable source. Otherwise, I will view this as another lie to bolster the status of an otherwise non-notable artist. Carlossuarez46 17:09, 22 October 2007 (UTC)Reply

I noticed the 'image' page specifies that the image is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a freely licensed image could reasonably be found or created that provides substantially the same information. If you believe this image is not replaceable, please:

  1. Go to the image description page and edit it to add {{di-replaceable fair use disputed}}, without deleting the original Replaceable fair use template.
  2. On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace the fair use image by finding a freely licensed image of its subject, requesting that the copyright holder release this (or a similar) image under a free license, or by taking a picture of it yourself.

If you have uploaded other fair use media, consider checking that you have specified how these images fully satisfy our fair use criteria. You can find a list of 'image' pages you have edited by clicking on this link. Note that even if you follow steps 1 and 2 above, fair use images which could be replaced by free-licensed alternatives will be deleted 2 days after this notification (7 days if not used in an article), per our Fair Use policy. Using one of the templates at Wikipedia:Fair use rationale guideline is an easy way to ensure that your image is in compliance with Wikipedia policy, but remember that you must complete the template. Do not simply insert a blank template on an image page.
