G'day, the best way to resolve this is to establish consensus about which photograph to use. That is done by discussing the matter here on the talk page. The site's main policy in this regard is bold, revert, discuss. You could also consider an request for comment, or dispute resolution. Ultimately, copyright can be tricky and image patrolling is a difficult area to work in. I'm not going to weigh into whether the image is useable or not as copyright law isn't my specialty. I simply ask that you try to establish consensus for your changes instead of continuing to edit war. As such, I would suggest that you outline here why you feel the image should be changed etc so that others can weigh in. Regardless, though, the proposed image appears to have been deleted due to licencing, so that would need resolution before it could be reinserted, if that is ultimately where consensus lies (this hasn't yet been established, though).
