Fair use rationale

The fair use rationale has come under fire on the file page on the grounds that the file can reasonably be replaced.

However, Hyde et al.'s image is scientifically accurate. Its copyright licensing does not permit the construction of a derivative work. A non-derivative replacement that involved original modifications would by definition involve a deviation from the factual data used to generate Hyde et al.'s image, and thus be inappropriate for use in the article.

Scientific data isn't copyrightable. If it's possible to generate this map on the basis of Hyde et al.'s data, then a free version of this map could be created, without deviating from their data, without being a derived work, and without being OR. +Angr 17:05, 15 April 2010 (UTC)

A table could be generated from the same data set and, if it uses the same conventions and layout, would be copyrighted. The principle works for a map. So a FUR is appropiate. --Philcha (talk) 21:02, 15 April 2010 (UTC)
