The video is copyrighted, but its use in the WinFS article qualifies as fair use because:

  1. the WinFS concept deals with abstract concepts. So, for better comprehension, more than text is needed.
  2. the article describes a WinFS Item browser that can be used to browse structured data type instances with their relations and properties. Since no existing applications exist which does this, a screenshot is very necessary to understand how the UI is exposed.
  3. the software is copyrighted, so free equivalent cannot exist.
  4. the WinFS project has been cancelled, and the public preview releases, which were time limited has expired. So it is impossible to use a self made screenshot.
  5. this does not limit, nor does it claim to limit, the rights of the copyright holder.
  6. it does not assist in illegal reproduction of either the software or the runtime.
  7. it is being used for informational purposes.

The thumbnail images in the screenshot is also irreplaceable, as self made screenshots cannot be created. As such, the thumbnail is also covered by the rationale.
