Summary edit

I took this image with a digital camera, cropped it in Photoshop, and saved it as a low-resolution jpeg. Fair-use rationale: This image is included for the purpose of "identification only in the context of critical commentary of that item." As I point out in my commentary of Historical America in Song, this particular album set is very similar to a later album set by Burl Ives. The images of both the cover and label will help people distinguish this set from the later set. Often old records have been separated from their sleeves and covers if they have survived at all. Therefore, an image of the album set's cover alone may not provide sufficient identification of this work for collectors and others. Moreover, the image of the record label serves as an illustration of the relatively rare Britannica Encyclopedia label from this period. Again, the image serves the purpose of identification.

Licensing edit

Fair use in Historical America in Song edit

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. It's a low resolution copy of a CD/album cover.
  2. It doesn't limit the copyright owner's rights to sell the CD/album in any way; in fact, it may encourage sales.
  3. Because of the low resolution, copies could not be used to make illegal copies of the album artwork on another CD.
  4. The image is itself a subject of discussion in the article or used in the infobox thereof.
  5. The image on the cover is significant because it was made by a famous artist.

Source edit

  1. Derived from a digital capture (scan/photo) of the album/CD cover (creator of this digital version is irrelevant as the copyright in all equivalent images is still held by the same party). Copyright held by the record company or the artist. Claimed as fair use regardless.
