Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

1. It illustrates educational articles about the album from which the cover illustration was taken. The cover features marionette caricatures of the band members, which is referenced in the page for the album in question.
2. The image is used as the primary means of visual identification of the article topic.This is a photo of the front cover of the LP for the album in the article; front covers are iconic works, directly associated with the song collections themselves.
3. The use of the cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies of the image could not be used to make illegal copies of the album artwork on another CD. The album was not released in the U.S. and has been out of print for 17 years. One would have a time of bootlegging the album with only the front cover, and no back cover or inner sleeve artwork.
4. It is a low resolution image. Mid-resolution is more accurate, it is not a hi-res scan, but rather a mid-range digital photograph (see metadata) and no reasonable print reproduction could be made from it; this is not a master-level reproduction, rather, a fair web-resolution image to illustrate the artwork to people reading the article.
5. The image is only a small portion of the commercial product. The image is 1/5th of the commercial product.
6. It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value. No other image of this album cover existed on the internet, by any searchable, catalogued means, prior to this photo.

This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the work or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution images of such covers solely to illustrate the audio recording in question, on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under the copyright law of the United States.
