Though this image is published by the BBC News, courtesy of the UNHCR and the photograph itself was taken by the Armed Forces of Malta and could be subject to proprietary rights either of the BBC, or the UNHCR or the Government of Malta, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

1. It is a significant picture that preceded an important event.
2. It is of much lower resolution than the original. Copies made from it will be of very inferior quality.
3. The image is only being used for informational purposes.
4. Its inclusion in articles relating to May 2007 Malta migrant shipwreck adds significantly to this/these article(s) because the image is the proper subject for commentary in the article.
5. The source explicitly states that the image was courtesy of UNCHR, an international, non-governmental, non-profit agency which deals with refugees-related issues.
