• it is a low resolution screenshot of a television episode;
• it does not, to any extent, inhibit the copyright owner's right to market any current product related to the television show in question;
• it helps to illustrate the television show in question by identifying a character important to the plot of a specific episode ("Return of the King") and;
• no similar or identical public domain image is known to exist.
