I don't have a strong objection to removing this (we have a marginally better image of Merritt elsewhere, and a much better image of Powers, both of which I also shot), but there may be some encyclopedic value, because I'm unaware of another picture available pairing these two. Ann Powers is a notable pop culture critic; Stephin Merritt is a songwriter known for his songs functioning as implicit commentary on other popular music. I believe that the 2006 Pop Conference is the only time they've ever been in each other's presence, so there may be some reason to keep this. For something that is critical to a person's notability for which there is no possible free replacement, this is acceptable. This is a critical event in a person's life and a free photo is just not possible. Sure, we have a free image of a Heisman trophy (not Salaam's) and we could possibly create a free image of him now/then, but getting this image free is not possible (though I guess photoshopping the two together?). I asked the school the license the image (actually many images) freely and they asked for more information and I responded and never heard from them again. Colorado does not want to license their images freely so this image can not be made free and can not be recreated and is critical in the biography of this man. This is a mighty close call, in my opinion. It's used in the "media work" section, which is appropriate. The cover is mentioned, of course, as is the notable fact that it was the first Indy-500-related cover in 20 years. Then again, as Abu badali says, the fact that she was on the cover is mentioned, but the cover itself is not described (nor should it be). I could really go either way on this one. If it is ever appropriate to use a magazine cover in an article where the fact is important but the cover itself is not, then it's appropriate here. The result of the debate was DELETE PER WP:FUC. The argument to keep is that this image depicts an unrepeatable event, one which must be illustrated. It isn't enough to merely claim that no free image can be made, but also that there's a compelling reason the event must be illustrated.

There is no convincing argument that the event must be illustrated, per WP:FUC #8. If a particular crowning or particular photograph of a crowning were a significant subject of commentary, then, yes, we could have an image. This subject has been quite controversial for months, and Abu badali has nominated these images for deletion in different venues and for different reasons multiple times. On one side of the continuing debate, Abu maintains that the images do not depict an event significant enough to warrant the use of a non-free image. On the other side, I (and others) feel that the crowning event is non-repeatable and important. I feel that this image and the three below pass all our non-free content criteria because:
1. Obviously the image depicts a non-repeating event. (This isn't in dispute.)
2. This event is of high importance in the model's career. In fact she wouldn't be noteworthy at all if the event did not happen.
3. The image is not being used in the article to depict the model's appearance. (It would be replaceable if it were used for that reason.) Instead, it is used in the section(s) that discuss the crowning event. It is not used at the top of the article or in an infobox.
4. Even if a free image of the model became available, it would be important in the article to depict the crowning event, and this cannot be done with a free image.

Abu has argued in the past that the image is merely decorative, not showing anything that a description of the event would not convey. This isn't an unreasonable argument, but I think the same could be said about nearly any photograph of a historic event. I agree with Qualdel's description of the dispute above. My position in this dispute is that I disagree with point #4. Although a Miss's crowing moment is unique, and of high importance to her career, it's not something that needs an illustration to be understood. That's why this (and similar) images do not significantly increase readers' understanding of the topic in a way that words alone cannot.

Just look for (news) websites mentioning a model that was once crowned. Will all of these websites include such an image? Surely not. Comment: These images are being used to fill the gap left by the deletion of unfree images of living people (replaceable images). It wasn't considered specially important to illustrate the "historical crowning moment" before the mass deletion of almost 200 (replaceable unfree) images of Misses. By the time of the mass deletion, only 2 or 3 Misse's articles had images showing a "historical crowning moment". So much of a beauty pageant is about appearance, and much of it is ephemeral and specific to that moment. Weak Keep I think there are critical moments that we must accept that we have to have an unfree image sometimes in a person's life. My reason for being weak here is because I doubt that a search was done for a free image, or a request for an unfree image to be licensed freely to us was ever done or made. Especially for recent cases such as this image, it's important to try and find a free image before using an unfree one. For older images, it becomes harder to do so, but still must rightfully be done. As I argued unsuccessfully before against Abu badali and others in defense of images I was using to illustrate a critical period/time/player/event in football, there are clearly images that relate directly to the text that the text just can not reproduce. You can not describe a rose ever with enough words, but simply showing a (free, if possible) rose will be better than all the text we could ever write. I would be very willing to change my opinion to keep if some statement or attempt was proven that free images were looked for, but not found. "Necessary"? that's not a realistic criterion. Strictly speaking, very few of the images in Wikipedia are "necessary". It's possible to write an encyclopedia using text alone, with the possible exception of mathematical diagrams. If we wanted to eliminate all fair-use media that was not "necessary" we'd just delete all of it.

Comment On a general note, I believe these types of images pass #8. This is a non-repeatable, historic event which probably is one of the most notable aspects of the people in question. I do not believe words alone can convey exactly what is in these images. I have a concerns related to critical commentary. I'm not sure At the conclusion of the final night of competition, outgoing titleholder Jennifer Berry crowned Lauren Nelson as her successor. Is really commentary, but instead relaying a simply fact. It is clear that various people have very different opinions, and I appreciate that everyone has, for the most part, remained civil. On one hand, it is clear and indisputable that this image depicts an event that will not repeat and, as such, cannot easily be replaced by a free image. (Note, however, that I dispute that non-free images of unrepeatable events are, by default, irreplaceable; this should be discussed at another time.) I appreciate Abu badali's concern regarding what he considers to be an inappropriate use of non-free content, and also PageantUpdater's concern that it her editing is being increasingly circumscribed by a stricter non-free content policy.
That said, I think it is unfortunate that, traditionally, "fair use" on Wikipedia has been interpreted as allowing non-free content when it is simply "irreplaceable" or "non-repeatable". I think that it is a misrepresentation of fair use. Remember the "four factors to be considered in determining whether or not a particular use is fair".
- "'The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;"
- "the nature of the copyrighted work;"
- "amount and substantiality of the portion used in relation to the copyrighted work as a whole; and"
- "the effect of the use upon the potential market for or value of the copyrighted work."
Upon reading through a review of recent court cases regarding fair use, it seems clear to me that the effect of the use upon the potential market is the most significant factor in case law.
Judging what is a fair use on Wikipedia and elsewhere is tricky and not clear cut; hence the prelude to our fair use policy, "Non-free content may be used on the English Wikipedia under fair use only where all 10 of the following criteria are met. These criteria are based on the four fair-use factors, the goal of creating a free encyclopedia, and the need to minimize legal exposure." As can be seen by reviewing the cases presented at the Stanford copyright website, copyright holders do regularly sue for copyright infringement; the need to minimize legal exposure is, unfortunately, necessary.
I have traditionally been of the opinion that images distributed as a part of a website with a restrictive terms of use or distributed by a news agencies are, barring exceptional circumstances, not a fair use. It seems clear to me, however, that the corporations who run websites "paint the [narrowest] possible license on [their] website to protect [their] intellectual properties".^{(—Nardman1 (now User:N))} One consequence, however, of Wikipedia's status as a top-ten website is that non-free content distributed on our website does, in my opinion, seriously affect the potential market for a copyright image. Some copyrighted images, by their nature, either do not have a market any longer or will be marketable even with our use of them, but I do not consider this image to be in either one of those "classes" of non-free content. Specifically, it depicts a very recent event that is, arguably, also a very significant event in global popular culture; its market is currently active, and yet not large enough to indicate to me that our use of the image has a neglibile effect. Indeed, I think that our use of the image has a significant effect on the potential market of the image.
My comments aside, I wish that fair use and non-free content were not such contentious issues on Wikipedia. To the closing administrator, please evaluate this as a consensual discussion. What is clear is that it is not clear whether or not an image is a fair use. But please consider the weight of the arguments, not the quantity of "keep"s versus "delete"s.
In fine, as disclosure, I came to this discussion upon recommendation on my talk page by Quadell who was seeking opinions. I admit that I was initially of the opinion that the image was not a fair use. While writing my comments, I vacillated between "fair use" and "not a fair use". Reply well images also came from places like Reuters, Gettyimages, Associated Press etc and they have all been well distributed on the internet... they appear on a number of websites and forums etc and it seems most people have ignored the copyright issue. Most people who use them won't have paid for the privilege. Some will say "used with permission" or the lke but I get the impression they are simply covering their behinds and haven't approached the owners at all. Is every goal one of the main reasons for a subject's notability? No, I don't think so. And you're missing the point. A goal is not exactly something that can be captured in a photograph, but what is so important in the crowning photographs are details such as the winners dress, hair, makeup, what she looks like, what her emotions are. This is all extremely important but it cannot be conveyed with words alone. Words cannot accurately illustrate the moment, and the moment will never be re-created. Keep only the image can properly convey what the titleholder looked like when she was crowned, including her gown, hairstyle, colours etc, and these images also show some of the outgoing titleholders and the sets, etc. A free image can illustrate what the titleholder looks like, but this serves another purpose. Showing the crowning moment is vital because it captures a historical moment of high importance to the article which cannot be replaced by a free alternative. The article Continuum (album) contains seven alternate non-free album covers and single covers for the album. I think this violates criterion #3 of Wikipedia:Non-free content. In my opinion, only one is needed to illustrate the article. The images are:

Neither of the Waiting on the World to Change images should be deleted as they're both in use on the song's page, likewise the cover of Gravity should be kept for the same reason. Otherwise, the album covers you mention provide an example as described within the album text. To remove these would nullify the text and remove encyclopedic context. Even if the nominator questioned their use in this article (which I absolutely don't) deletion would be the wrong course of action for most of them, as they are well-used in other articles, and the John Mayer article is an FA candidate that seems to be going towards approval; (b) The article in question specifically goes into detail about the history and descriptions of the covers, in which countries they were used, and also Mayer's involvement in the cover design, so the fair use argument is strong; (c) there is precedent of a billion articles containing multiple album covers. I would dare say it is preferable or even requisite for featured articles (Examples: [1] [2] [3] [4] [5] [6] ); (d) The policy cited is usually used to argue against scenarios like ten screencaps from one movie, or eight music samples from the same album. In this case, the covers illustrate the varying covers that often aren't even available to different users. If we only use one cover, which should we use? The one used in the United States? How would that invoke recognition to European readers? What if we use the one in the UK? Over a million buyers in North America would have no recognition of the album. Or in the case of other articles of a similar nature, should we use the releases in Japan, or Swaziland or Mexico?
