Gay marriage in Japan edit
Hey, I just noticed this edit of yours. I reverted, but I hope you don't take offense. My reasoning was that "constitutional ban" implies the Japanese Constitution contains a specific clause banning gay marriage. It is heteronormative in its wording, but only in that it assumes heterosexual marriage in Article 24, which is clearly not about gay or straight marriage, but about equality of sexes and the right of both partners not to marry against their will. The exact wording in English is Marriage shall be based only on the mutual consent of both sexes and it shall be maintained through mutual cooperation with the equal rights of husband and wife as a basis. With regard to choice of spouse, property rights, inheritance, choice of domicile, divorce and other matters pertaining to marriage and the family, laws shall be enacted from the standpoint of individual dignity and the essential equality of the sexes. You will also note that even when quoting the Constitution in the context of discussing gay marriage not being permitted in Japan, news articles such as this one seldom if ever refer to a "constitutional ban". Lithuania and Belarus constitutional ban on same-sex marriage edit
I did refer to the talk page and nowhere did I see an explanation why either of the countries would be removed. the Lithuanian constitution clearly states in Chapter 3 Article 38 "Marriage shall be concluded upon the free mutual consent of man and woman." while the Belarusian constitution clearly states in Section 2 Article 32 "On reaching the age of consent a woman and a man shall have the right to enter into marriage on a voluntary basis and found a family." So what is your reason for the removal of those two countries from the list of the countries which constitutionally banned same-sex marriage. --Turnless (talk) 15:28, 21 July 2016 (UTC)
- The wording of marriage definition in the Belarusian and Lithuanian Constitution articles are similar to the wording the old Armenian Constitution. Article 35 of the (old) Constitution of The Republic of Armenia stated that: 'Men and women of marriageable age have the right to marry and found a family according to their free will. They are entitled to equal rights as to marriage, during marriage and divorce.', which (was perceived by the Armenian lawmakers and the LGBT groups as) a lack of a definition of marriage.
- On top of that, I did mention that as the effect these Constitutional articles, which is in order to recognize same-sex couples to have the same marital rights to heterosexual couples, overturning the current legislation is required (Lithuanian Parliament's Committee on Legal Affairs stated that legalizing same-sex partnership is constitutional); remains unknown, then the Belarusian and Lithuanian Constitutions should NOT be perceived as having a ban on same-sex marriage when no legal decision has been made.
- Furthermore, the description of a woman and a man shall have the right to enter into marriage is hardly a constitutional ban against same-sex marriage, but a constitutional protection of the equality of sexes and the right of both partners not to marry against their will. - I do not see how the Lithuanian wording is a lack for a definition of marriage as it does clearly state that the consent must come from a man and a woman. The Belarusian statement is a different story. Where did you say you discussed this though? I checked both talk pages and could not find anything about this. If you did can you show me where it is. If you did not then you should first discuss before removing. these countries have been on the list for a very long time and if they are going to be removed that should be discussed first. - I don't know why you copied the same message again to my talk page, I have already seen it. I also wanted to add a comment about your mention of the Lithuanian Parliaments statement about same-sex partnerships. Banning same-sex marriage doesn't ban other same-sex partnerships. Croatia and Hungary both constitutionally ban same-sex marriage while allowing life partnerships and registered partnerships for same-sex couples respectively. --Turnless (talk) 18:25, 21 July 2016 (UTC)
- I found the comment you made on the talk page of LGBT rights in Europe. There isn't a single other user who has commented yet. Wait for a discussion to happen and reach a consensus through that. Those two countries have been on that list for a very long time and removing them should be agreed on. The Wikimedia LGBTQ+ User Group is holding online working days in May. As a member of WikiProject LGBT studies, editing on LGBTQ+ issues or if you identify as part of the LGBTQ+ community, come help us set goals, develop our organisation and structures, consider how to respond to issues faced by Queer editors, and plan for the next 12 months.
We will be meeting online for 3 half-days, 14–16 May at 1400–1730 UTC. While our working language is English, we are looking to accommodate users who would prefer to participate in other languages, including translation facilities.
