If you're looking at how to produce the same effect, type this into your "preferences":

I need a lawyer and you were the first one in the list

Hi! I'm hoping to get info from a wikipedian who is a lawyer on NY laws relating to child sex abuse (not for myself, for an article). I saw you in the list of wikipedian lawyers so I'm trying you. :-) If you don't know or don't want to answer, no biggy. Here's the question: in the incest article this statement is made:

"In New York, sex with a child under the age of 11 is a Class B felony, punishable by up to 25 years in prison. The law is indexed appropriately, in the chapter on sex offenses. If, however, the sexually abused child is closely related to the perpetrator, state law provides for radically more lenient treatment (emphasis added). In such cases, the prosecutor may choose to charge the same acts as incest. This (incest) is not listed as a sexual offense, but instead as an 'offense affecting the marital relationship', listed next to adultery in the law books. It is a Class E felony, for which even a convicted offender may be granted probation."

How can I find out if it's true, and how relevant it is? I'm trying to tone down rhetoric and emotionalism in the page, and I want to make sure it isn't just fear-mongering (or worse, incorrect). Any help would be appreciated.--Anchoress 09:14, 27 April 2006 (UTC)Reply


This is a reply to your question for your article. I apologize that I am unable to assist you, I deal primarily in corporate and copyright law. I tried looking around a bit throguh NY laws and found this:

 A  person  is  guilty  of  incest when he or she marries or engages in
sexual intercourse, oral sexual conduct or anal sexual  conduct  with  a
person  whom  he  or  she  knows  to  be  related  to him or her, either
legitimately or out of wedlock, as an ancestor, descendant,  brother  or
sister  of  either  the  whole or the half blood, uncle, aunt, nephew or
niece.
  Incest is a class E felony.

Which may be of use and seems to be in line with the other quote. I recommend you look around and don't post something untill you can credit to a reliable source. Once again, I apologize that I am unable to be of greater assistance.
