Talk:Scottish criminal law

Out of date edit

Some of these offences (I particulary noticed incest) have been consolidated by the Criminal Law (Consolidation) (Scotland) Act 1995. Oddly, the changes were not listed in the cumulative index (2007) to the Stair memeorial encyclopedia that I was using (perhaps it was for a later edition - I didn't check). It will need to be corrected, but don't get rid of historical information altogether. James500 (talk) 02:18, 5 February 2009 (UTC)Reply

List of crimes edit

Is it really necessary to try to create an exhaustive list of crimes in Scotland? The list is not complete anyway as it ignores most statutory offences in Scotland. Connolly15 (talk) 01:10, 31 March 2009 (UTC)Reply

The crime of "hamesucken" is no longer considered or charged as a distinct crime in the common law, but rather as an aggravation. I would cite Jakovlev and Podgornoi v HMA 2012 JC 120, in which Lord Hardie said "Although hamesucken is no longer charged as a specific crime, it is nevertheless still regarded as an aggravated form of assault" (at p 131, para 12). I would suggest moving "hamesucken" to a sub-group of assault on this page, or to a list of aggravations of assault in Scots law. Perhaps on the Assault page. I am looking to more senior editors for advice. TheTallSomething (talk) 14:39, 23 November 2017 (UTC)Reply
