Opponents of judicial activism have often been critical of the living tree doctrine, claiming that it gives Supreme Court judges the ability to impose whatever laws and norms they choose on the whole of Canadian society. For instance, critics have argued that bestiality and pedophilia could eventually become legalized in Canada because of the living tree doctrine, meaning that the Court would have has no choice but to accept it, given that a significant minorty of Canadians have already embraced it as part of their lifestyle.
