I think this needs some work. According to Black's Law Dictionary, abridged 8th edition, capias as respondendum is "A writ commanding the sheriff to take the defendant into custody to ensure that the defendant will appear in court." This is different than the wiki article in that it is broader in scope. The wiki article says "...to hear the judgment to be imposed." This indicates that a judgment has been decided and that the defendant has no recourse to the charge or action. The Black's defintion indicates that the defendant will have to appear in court, but leaves open the option of defense. I think. Of course I'm only in my fourth week of law school.
