Confusing statement edit

Under the appeal section, the last statement of the first paragraph: "The court was also presented with the fact that during the time the crime was committed Gell had been out of state or arrested for stealing a car and was serving a sentence in jail" is just a tad confusing. As I'm not familiar with the case to correct that (I'm making an assumption that it should be and instead of or), I'm asking someone more familiar to make it more legible. —Preceding unsigned comment added by 155.45.81.25 (talk) 23:15, 5 September 2007 (UTC)Reply

Statutory Rape Charge edit

Maybe I'm naive, but doesn't the ten years he spent on death row count for anything? Shortly after he got out of prison, he began a relationship with a 15 year old girl. They now have an 18 month old child together. Because of this relationship, he was charged with statutory rape and sentenced to five years in prison, which he is now serving. The State of North Carolina won't allow his girlfriend and child to visit because they are considered "victims". How asinine is that? She says the relationship was consensual, and wants to visit him in prison, but the state apparently has a grudge against the man that embarrassed them by proving he wasn't guilty of murder, so now they have found a reason to throw him back in jail and deny his family the privilege of seeing him. 69.134.207.246 (talk) 22:53, 27 December 2007 (UTC)Reply

This needs help edit

There is nothing in this article indicating how the police came to suspect anyone of this crime. If they didn't have any evidence, why did the two fifteen year old girls testify against Gell? If they did have evidence or fabricated evidence then what was it? The article makes it look like two girls testified against him and took ten year prison sentences for no reason. Agree this needs work. From what I can learn, apparently the girls were first questioned by police and were suspects themselves in the murder and robbery, as they were known to frequent Jenkins' house. Their accounts changed several times. They were initially charged with first-degree murder, and implicated Gell in the murder. Their charges were reduced in exchange for a plea bargain and their testimony against Gell. The police found that he had been out of town during much of the first two weeks in April, and developed a theory that he had committed the murder on April 3 (the last day he was available to do so.) The prosecutor suppressed eyewitness evidence by persons who saw Jenkins alive several days after he was supposed to have been killed, leading the medical examiner to conclude that Jenkins had been killed April 3.Parkwells (talk) 00:14, 6 June 2017 (UTC)Reply
