Want to know why your pictures of Smalkin keep getting deleted? It's because you are using the wrong license. It is NOT a work of the United States Federal Government, nor is it a work of the Department of Defense. It is a work of the MARYLAND state government. State defense forces fall under the states, not the federal government. That is why he is wearing a red name tag, not black, and "MD" on his collar, not "US." You need to find the right license. I suspect this is Smalkin, so if it is, you can release it yourself using one of the appropriate licenses such as {{PD-self}}. I think this photo was taken by a member of the United States Army as an official portrait for posting at the Maryland National Guard Headquarters. The individual's affiliation does not mean that the photo was not taken by a member of the Army.
