Image at Priscilla Jana

Hi there. I am following up here to see if you can help me with the fair use path for getting an alternate image. Given that my email on Wikipedia is the same one that I use for my off-Wiki activities, I dont think I might be able to send an email to SAHO website. Greatly appreciate all assistance. Ktin, sure thing and I was just about to leave you a note thanking you for all your work on a difficult subject. The encyclopedia is much better for it.
So one sticky bit is for fair use we need to get this image removed first—can’t make a fair use claim if there’s a legitimately licensed image available. I tried to look for another one just now, including looking at videos because if a video is CC licensed, we could use a screen grab. No luck tho. So the best way to proceed, if you agree, is I’ll nominate this for deletion, because I do believe we don’t have the right permissions, and then we’ll pick another image to upload at low-res just to identify her, which are the fair use criteria. How does that sound/does it all make sense? I know image rights can be confusing. Innisfree987 (talk) 23:58, 28 November 2020 (UTC)
Just as an FYI, you might consider making a dedicated email for your Wikipedia account (it’s free with Gmail or similar providers) because I see you have email enabled on your userpage. If anyone writes you that way, it will go to your personal email and if you reply, it will show the other user your address. So if you have privacy concerns, a dedicated email is a good idea. Hello, this caught my eye because I am trying to sort out a similar case where a collection is CC-licensed but the photographer appears unknown and therefore cannot have assented to the license. The SAHO themselves say, “Please note that these externally created materials on the site are protected by South African copyright law and may not be reproduced, distributed, transmitted, displayed, or otherwise published in any format, without the prior written permission of the copyright owner. We always try to supply owner details and obtain permission from these owners, but in some cases we have not been able to trace some rights owners.” Jana appears to be such a case as her page indicates no information on the photographer. So I’m afraid for WP purposes we don’t have the necessary permissions for this one. Does that sound right to you KittenKlub? But not all is lost: we could try for a fair use claim on this or another image of Jana instead, since she is deceased. Innisfree987 (talk) 01:40, 29 November 2020 (UTC)

I’ll start the deletion process at the Commons and if you want to look around for images of Jana you like—essentially any could be fair use but one from the SA gov would be ideal as it might already be free. There’s also this one, which I think might be free because SABC News is government-owned, but also if you don’t feel good about any, we could go with a different image altogether—it should be ok with “minimal” usage (using it just once on one entry to identify her). I see they just have the two wide angles so it will be a photo of her among others but I think it should definitely add something to the entry until a real photo can be acquired.
