Additionally, use of this copyrighted image in the article List of giant squid specimens and sightings (21st century) is believed to be fair use on the grounds that:

As the first photograph of a live giant squid in its natural habitat, the image depicts a historically significant and widely reported event. It is intended to show: (a) a representative image of the event itself, discussed in the adjoining text, which cannot be conveyed in text alone; (b) the appearance of the animal in its live state, specifically its head and arm posture; (c) its horizontal orientation in the water column when attacking prey, which dispelled previously held notions about its feeding habits; and (d) its python-like mode of attack, enveloping prey in an irregular ball with its two long tentacles, which was likewise contrary to prior scientific views. The photo constitutes a single downsampled and low-resolution (<100k pixels) image from a series. It is irreplaceable as it depicts a historical event of which no free images exist. It is used here strictly for educational purposes.
