Fair Use rationale for image in Fordham Intellectual Property, Media & Entertainment Law Journal edit

• As a periodical publication, magazine cover fair use is the most appropriate rationale.
• Since the subject of the article is a publication, an image of its cover is the only practicable illustration.
• As is the convention with law reviews, the table of contents appears on the cover; this is not an inside contents page.
• The resolution is minimum necessary to read the significant text on the cover.

It is believed that the use of low-resolution images of magazine covers to illustrate the publication of the issue of the magazine in question with the publication name either visible on the image itself or written in the image description above, on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law.
