Sept 13, 2007: This is a 1964 photo of Herbie Phillips (Herbert Daly Phillips) (1935-1995), trumpeter, big band composer, and arranger. It was taken by Kenny Bright, also trumpet player who died 35 years ago. Carl Saunders hired Kenny take this and other photos at a concert with his band, "The Carl Saunders Jazz Orchestra." The venue was Rancho High School, Las Vegas, NV (Carl's school). This particular photo was first published in the United States without copyright notice prior to 1978, which, by law, means it is irrevocably in the Public Domain. Nonetheless, Carl has agreed to release this photo under the free license.

This work is in the public domain because it was published in the United States between 1929 and 1977 inclusive, without a copyright notice.
