Fair use rationale for use in At the Drop of a Hat
The use of the image qualifies for the fair use doctrine under the copyright laws because:
- it is a low resolution image;
- that cannot be replaced by a substitute as both person shown are deceased and no equivalent free image exists;
- its use will not deprive the copyright owner of income; and
- it is being used as the sole visual identification of the revue and is being shown on this non-profit website solely for comment and education.
