1. it is a promotional screenshot of a television character;
2. it does not limit the copyright owner's rights to sell the DVD of the show in any way;
3. copies could not be used to make illegal copies of the program;
4. the image is accompanied by a description of the characters role and critical commentary of their importance on the show;
5. the image is significant because it identifies a starring character and the subject of the article.
